These Terms of Service (“Terms”) govern your use of OpenPull (“we”, “us”, “our”), accessible at openpull.ai. By accessing or using OpenPull, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Description of Service

OpenPull is a platform that connects open-source contributors with projects seeking help. We analyze public GitHub repositories, match users with projects based on their stated interests and skills, and facilitate collaboration between contributors and maintainers.

2. Accounts

You must authenticate via GitHub OAuth to use OpenPull. You are responsible for maintaining the security of your GitHub account. You must be at least 13 years of age to use this service. By creating an account, you represent that the information you provide is accurate.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

  • Use the platform to spam, harass, or abuse other users
  • Scrape, crawl, or programmatically access OpenPull without written permission
  • Abuse the analysis pipeline by submitting repos in bad faith or manipulating match results
  • Circumvent rate limits, access controls, or other technical restrictions
  • Impersonate another person or misrepresent your affiliation with a project
  • Use OpenPull to distribute malware, phishing links, or other harmful content
  • Interfere with or disrupt the service or its infrastructure

4. User Content

“User Content” includes collaboration proposals, status updates, profile information, and any other content you submit to OpenPull.

  • You retain ownership of your User Content
  • By submitting User Content, you grant OpenPull a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the service
  • You represent that you have the right to submit any User Content you provide
  • We may remove User Content that violates these Terms or that we reasonably believe is harmful

5. Intellectual Property

OpenPull does not claim ownership of any open-source repositories analyzed on the platform. Repository data (descriptions, stars, languages, contributors) is sourced from public GitHub APIs and displayed for informational purposes.

AI-generated analyses, match scores, and recommendations are provided by OpenPull and are our intellectual property. You may reference these analyses but may not systematically reproduce or redistribute them.

6. Service Availability

OpenPull is provided on an “as is” and “as available” basis. We do not guarantee any specific uptime, availability, or performance. We may modify, suspend, or discontinue any part of the service at any time without notice.

7. Limitation of Liability

To the maximum extent permitted by law, OpenPull and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of the service
  • Any bugs, viruses, or similar issues transmitted through the service

Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless OpenPull, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the service or violation of these Terms.

9. Privacy

Your use of OpenPull is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform at least 14 days before taking effect. Your continued use of OpenPull after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Marion County, Indiana.
